Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

The Neroli Clinic has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that The Neroli Clinic shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By visiting www.neroliclinic.je, you are consenting to the privacy policy and terms and conditions of this site. Policies may be updated at any time. By using this site you acknowledge that it is your responsibility to review these policies and be aware of any modifications.

Privacy Notice

Data protection laws are changing and this notice explains why we collect your personal data and what we do with it. It ensures we are working in accordance with the newly revised Data Protection Act 2018; terms from the act are indicated in bold below.

When you supply your personal details to us, when we communicate by email, and when we take notes in the clinic, this information is stored and processed for four reasons in line with the Data Protection Act requirements:

1. We need to collect personal information about your health in order to provide you with the best possible treatment. When you request treatment and we agree to provide that care, it constitutes a contract in law.

2. We have a legitimate interest in collecting that information because without it we could not practice our treatments professionally, effectively or safely.

3. We keep records of your contact information because we think that it is important to contact you in order to confirm your appointments or to keep you informed in any matters concerning your medical care. This again constitutes a legitimate interest , but this time it is your legitimate interest.

4. Provided we have your consent we may occasionally send you individualised health information by email in the form of a newsletter, articles or advice. You may withdraw this consent at any time – you just have to let us know by any convenient method.

We have a legal obligation to retain your records for 7 years for Acupuncture and 8 years for Physiotherapy after your most recent appointment (or after you have reached age 25, if this is longer), but after this period you can ask us to delete your records if you wish. Otherwise, we may retain your records indefinitely in order that we can provide you with the best possible care should you wish to see us at some future date.

Your clinical records are stored only on paper and in secure locked filing cabinets at the clinic. Occasionally your notes may be transferred out of the clinic but they will be kept with us at all times or locked safely. 

Your emails are kept in a file on our password protected computers at home or password protected mobile phones. Initial Emails received via our website are only seen by Jane and Polly. Invoices which we send out to those people who pay by bank transfer are also kept in locked cabinets. These invoices mostly record dates of appointments, names of clients and the appointment fee. Some invoices record addresses of clients only if requested by yourself for the purposes of claiming clinic fees on insurance.

We are the only people who have access to your records, invoice files and emails. We will never share your information with anyone who does not need access without your written consent.

Only the following people will have routine access to your relevant data:

You have the right to see what personal data of yours we hold and you can also ask us to correct any factual errors. We also request that you notify us of any change in your personal details at your next appointment so that we can keep your files up to date. We are legally required to respond to any request from a client to see their personal data within a timescale of 40 days.

Please be assured that we treat your personal data responsibly and with due respect, ensuring that the only people who can access that data have a genuine need to do so. In the case of our practice this would most likely be with your general practitioner, medical consultant or referral to another health professional.

In the first instance if you have any concerns about the handling of your data please speak to either Polly or Jane to decide on a suitable course of action.

If you are not satisfied with our response then you have the right to raise the matter with the directly with the Information Commissioner’s Office.
